FitFactor OFFICIAL RULES The Navy Child and Youth Programs FitFactor
promotion is intended to help stimulate interest and awareness of the importance
of healthy lifestyle choices for our youth and teens; increase participation and
awareness of Navy programs and services; and to further improve the Quality
of Life of our military community and families. We hope you enjoy the FitFactor
experience! Maintaining the integrity of this program is a must. All eligible participants
have an equal opportunity to achieve all the FitFactor levels. In our efforts to
maintain program integrity, any violations of the rules, or intent to deceive, may
result in a loss of privilege/eligibility. Incentives are based on personal achievements
and activities entered at the FitFactor website by the participant. The goal of
the FitFactor program is to encourage youth and families to Get Up, Get Out, and
Get Fit and provides incentives to help them stay on target. Since there will be
limited verification of actual event participation, all entries will be based on
the honor system. Only enter points for activities that you have completed. Remember
character counts!
ELIGIBILITY, DISCLAIMER: FitFactor eligibility is OPNAV 1700.9E, Child and Youth Programs and Use Eligibility. As such it is open to youth between
the ages of 6 and 18 years old who are family members of active duty, guard and
reserve members of the armed forces; DoD civilians; retired military members; honorably
discharged veterans with 100% service-connected disability; and former and/or surviving
military spouses and their family members. However, all initial enrollments will
be conducted in an Navy base youth center, so proximity to an active Navy
base is required.
GENERAL RELEASE, NOTIFICATION, DELIVERY AND INCENTIVE ACCEPTENCE:
By joining the FitFactor initiative, participants release Aspen Marketing, Navy Child and Youth Programs and the United States Navy, and each of their respective parent companies,
subsidiaries, divisions and agents, and each of their officers, directors, employees
and agents from any liability whatsoever for any liability or other cause of action
arising directly or indirectly from their participation in this program. By signing
up, participants acknowledge compliance with these official rules, including all
eligibility requirements. Navy Child and Youth Programs reserves the right to verify eligibility
qualifications of any youth entering the FitFactor site. By accepting an incentive,
the participant agrees to release and hold commercial sponsors, and each of their
respective parent companies, subsidiaries, divisions and agents, and each of their
officers, directors, employees and agents harmless from any and all losses, damages,
rights, claims and actions of any kind resulting from acceptance, possession or
use of any incentive, including without limitation, personal injuries, death and
property damage. Void where prohibited.
NOTIFICATION AND DELIVERY: Level Incentives –
When participants achieve each FitFactor level they will be notified of their accomplishment
right on the website and prompted to print out a certificate of completion that
they may keep. If a participant is unable to print the certificate of completion
they may go to the designated Navy youth center for assistance. Once a level
is reached, participants can then go to the Navy youth center to claim their
incentive. Bonus Incentive Drawings – In addition to Level Incentives
there are also Bonus Incentive Drawings. Aspen Marketing will notify Bonus Drawing
selectees and the base youth center via email and direct the youth to the youth
center to claim their incentive. Youth must pick up their Bonus Incentives within
14 days. Certain Bonus Incentives will need to be mailed and delivery/shipment of
incentives will be within 30 days of selection. If the participant is unable or
unwilling to accept the incentive, or if Aspen Marketing cannot affect delivery
because the participant has not provided contact information, the incentive will
be forfeited. Internet registration further ensures information gathered to be complete/accurate
and offers opportunities for bonus incentives.
ACCEPTING INCENTIVES: Participants by entering into the
FitFactor website and/or acceptance of incentives (a) agree that neither US Navy Child and Youth Programs, and their respective affiliates, parent companies, subsidiaries,
agents, divisions, advertising and promotion agencies, or any telephone network
or service providers, and all of their respective officers, directors, employees,
representatives and agents will have no liability whatsoever for, and shall be held
harmless by participants against, any liability for any injuries, losses or damages
of any kind to persons, including death, or property resulting in whole or in part,
directly or indirectly, from acceptance, possession, misuse or use of the incentive
or participation in this program or any program related activity, and (b) except
where legally prohibited, grant permission for US Navy Child and Youth Programs and official
sponsors and those acting under their authority to use his/her name, photograph,
voice and/or likeness, for advertising and/or publicity purposes without additional
compensation.
MISCELLANEOUS: Privacy Act Information. We respect your
privacy. We will not disclose individual names or email addresses to third parties.
In some instances, individual usage and transaction data may be used for us to contact
FitFactor participants if necessary.
